With the changes to state laws across the country regarding the legalization of medical and recreational marijuana, employers have started to revisit their drug testing policies. Marijuana is still an illegal drug under federal law and the Trump administration is signaled they they will be getting tougher on enforcement of federal drug laws, especially in the states where recreational pot is legal. Employers also remain concerned about workplace safety because while pot use can be detected, there is no widespread way to measure impairment. This is an evolving area of the law and a real challenge for employers who are increasingly desperate to find and retain workers.
